This Acceptable Use Policy (“AUP”) has been developed by ISG Development, LLC (“The Company”) to ensure the responsible and lawful use of our services by customers and users (“Users”). The following guidelines outline the terms and conditions governing access to and use of The Services, with the goal of maintaining the security, reliability, and integrity of our services while promoting safe and compliant usage for all parties involved.
General Terms and Conditions of Use
The Company’s servers, systems, websites and related services (collectively referred to as “The Servers” or “The Services”), may only be used for lawful purposes. Users may not use The Services to:
- Transmit, distribute, or store material in violation of any applicable laws;
- Infringe upon the copyright, trademark, trade secret, or other intellectual property rights of others;
- Violate the privacy, publicity, or other personal rights of others;
- Engage in fraudulent, deceptive, or misleading practices, including phishing schemes or impersonation;
- Engage in unauthorized cryptocurrency mining or other resource-intensive computing tasks that impair system performance or availability;
- Sell, promote, or distribute illegal goods, services, or substances;
- Post or distribute content that is obscene, threatening, abusive, hateful, or advocates violence, terrorism, or harm to any individual or group;
- Harass, defame, or intentionally cause emotional distress to individuals or groups;
- Promote or glorify self-harm, suicide, or other forms of serious injury.
Users may not consume excessive system resources in a way that disrupts or degrades the normal operation of services for others.
User Responsibility
It is the User’s responsibility to remain informed of and comply with all applicable laws and regulations related to their use of The Services. This includes, but is not limited to, compliance with U.S. laws such as the CAN-SPAM Act, the Computer Fraud and Abuse Act (CFAA), the Digital Millennium Copyright Act (DMCA), the Electronic Communications Privacy Act (ECPA), the Stored Communications Act (SCA), and Export Administration Regulations (EAR) as well as any applicable international laws such as the EU General Data Protection Regulation (GDPR), Canada’s Anti-Spam Legislation (CASL), and other applicable data protection and anti-abuse regulations.
Users must also ensure compliance with additional laws and standards applicable to their use of The Services, such as the Children’s Online Privacy Protection Act (COPPA), the Health Insurance Portability and Accountability Act (HIPAA), and the Payment Card Industry Data Security Standard (PCI DSS).
Users are responsible for ensuring that their use of The Services, including use by their employees, agents, and clients, complies with all legal requirements and does not violate any terms set forth in this AUP. Users must take reasonable steps to ensure that their employees, agents, and clients understand and comply with this AUP.
In addition to this AUP, Users may be subject to additional service-specific agreements depending on the services they use. These may include, but are not limited to, a Domain Registration Agreement, Hosting Agreement, or other applicable service contracts. It is the User’s responsibility to review and comply with all such agreements, which are incorporated by reference and form part of the overall terms governing use of The Services.
System and Network Security
Users are prohibited from attempting to violate or bypass the security measures of The Servers, including but not limited to:
- Accessing data not intended for them, or logging into accounts or systems they are not authorized to access;
- Probing, scanning, or testing the vulnerability of systems or networks without authorization;
- Interfering with or disrupting service to any user, host, or network through methods such as overloading, flooding, or crashing systems;
- Forging any packet headers or any part of header information in emails or newsgroup posts;
- Attempting to gain unauthorized access to any systems or services;
- Uploading, distributing, or executing malicious software such as viruses, worms, or Trojan horses;
- Uploading or distributing corrupted files or other software intended to disrupt or damage systems;
- Using automated tools to exploit, disrupt, or gain unauthorized access to any systems or services;
- Engaging in spoofing, phishing, man-in-the-middle attacks, or other deceptive practices intended to intercept, manipulate or falsify communications or data.
Violations of system security may result in civil or criminal liability. The Company will investigate potential violations and may involve law enforcement if necessary.
Prohibited E-Mail Practices, Including Spam and Fraud
Users may not use The Services to send unsolicited email messages (“Spam”), including bulk commercial advertising, informational announcements, or other forms of promotional content that could negatively impact The Services or violate applicable laws. Spam is generally defined as any unsolicited email sent without the recipient’s express prior consent, typically for commercial, promotional, or bulk distribution purposes.
Users are strictly prohibited from:
- Sending excessive, harassing, threatening, or deceptive email communications;
- Continuing to send emails to recipients who have opted out or requested not to receive further messages;
- Using forged, misleading, or altered email headers or sender information;
- Sending malicious content, including viruses, phishing attempts, or mail bombing;
- Violating any applicable anti-spam legislation, including the CAN-SPAM Act, the GDPR, or the acceptable use policies of other Internet service providers;
- Using email accounts as dedicated storage or repositories for non-communicative data;
- Buying, selling, renting, or soliciting email address lists for use in bulk email campaigns.
Users must ensure they have obtained prior explicit consent (opt-in) from recipients before sending any marketing or promotional emails, in full compliance with applicable anti-spam laws.
The Company reserves the right to suspend or terminate services for any User found to be engaging in spam or abusive email practices, with or without prior notice.
Prohibition of Child Pornography
The Company will fully cooperate with any investigation into violations of the Child Protection Act of 1984 concerning child pornography. Users are responsible for the actions of their employees, agents, or clients on The Servers and may be held liable for illegal content uploaded or distributed by those parties. Child pornography, as defined under the Act, includes any explicit depictions involving individuals under the age of 18.
Users are strongly encouraged to report any suspected child pornography or related illegal content encountered while using The Services to The Company immediately. The Company may also notify and cooperate with law enforcement as appropriate.
Any violations of the Child Protection Act will be reported to the U.S. Customs Agency. No credits or compensation will be issued for service interruptions resulting from violations of this policy.
Suspension and/or Termination
Users found to have violated any portion of this AUP may receive a warning and may be subject to temporary suspension, pending an agreement to cease further violations. Temporary suspension is at the discretion of The Company and may remain in effect for a specified period or until the issue is resolved. In cases of serious or repeated violations, The Company reserves the right to suspend or terminate service immediately without prior notice. Users may appeal a suspension or termination, or request clarification, by contacting The Company within 30 days.
Company Responsibility
The Company is not responsible for content posted by users on The Servers, nor for the content of any external websites linked from The Servers. Links are provided solely for convenience and do not constitute an endorsement of the linked content.

Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the state or federal courts located in Vermont, and the parties hereby consent to the personal jurisdiction and venue of such courts. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a continuing waiver of such term or any other term.
Entire Agreement and Amendments
This AUP constitutes the entire agreement between the parties regarding acceptable use of The Services and supersedes all prior discussions, agreements, or understandings, whether written or oral, regarding the use of The Company’s servers and services. This policy does not modify or replace any other terms and conditions that govern the use of The Company’s servers and services.
The Company reserves the right to update or amend this AUP at any time. Users will be notified of any material change via email, through The Company’s website or other reasonable means of communication. Continued use of The Services after such changes constitutes acceptance of the revised terms.
